The attorney for Ghislaine Maxwell’s team stated that they will appeal the verdict of guilty.
According to her lawyers, Ghislaine Maxwell should have been shielded by “immunity provisions” in a previous non-prosecution agreement made in Florida.
This week, lawyers have appealed the 2021 conviction of the 62-year-old British socialite who was disgraced due to charges of sex trafficking.
During a court hearing in New York on Tuesday, Diana Fabi Samson, representing Maxwell, mentioned the 2008 agreement between state prosecutors and the late paedophile Jeffrey Epstein in Florida.
According to Ms Samson, failing to fulfill the terms of the agreement would severely damage the trust between the government and its citizens.
Ms. Samson stated that ultimately, Ms. Maxwell was charged with offenses that she, as a beneficiary to the plea deal in Florida, should not have faced.
On Tuesday, Maxwell was not physically in the court room. However, it was reported that she was listening from her jail cell in Florida.

The issue of an “impartial juror” was not brought up during Tuesday’s hearing, but Ghislaine Maxwell’s attorneys addressed it later outside of court.
Arthur Aidala stated that it was wrong for juror Scotty David to not disclose that he was a victim of sexual assault. He also claimed that Mr. David had completely misrepresented the truth.
To make matters worse, he then appeared on television and boasted about his significant involvement in the jury, serving as an expert witness to highlight weaknesses in the prosecution’s argument and speaking as a victim of a sexual offense.
“That is completely forbidden. It is incorrect. Despite the judge’s hearing, where he admitted to his mistake, the verdict stands because he did not check off a box, which was probably an honest error on his part.”
According to Mr Aidala, if we permit this to occur in America, we are all at risk. It could potentially affect your family members who may be on trial, and it’s important to have unbiased jurors who have not had similar experiences that could cloud their judgment.
The key is to show fairness, but sometimes life events can prevent someone from being completely impartial. This was the situation with the jury of Ghislaine Maxwell and Mr. David acknowledges his significant involvement.
Therefore, this would lead to a new trial if the grounds for the case were to be overturned.
Mr Aidala stated that the case ought to be “thrown out”, and further clarified, “If we permit the government to negotiate with us and then they choose, for any reason, to go back on their word, that agreement holds no value.”

The agreement was brokered by ex-federal prosecutor Alex Acosta, ultimately leading to a prison term and the requirement for the disgraced financier to register as a sex offender.
In accordance with the 2008 Non-Prosecution Agreement (NPA), Epstein admitted to state charges in Florida for soliciting and obtaining a minor for prostitution. This allowed him to avoid a potential life sentence and instead participate in a work-release program for 13 months. He was also obligated to make restitution to his victims and register as a convicted sex offender.
In 2019, Epstein was accused by federal prosecutors in Manhattan of very similar charges. However, he died by suicide while in federal custody before his trial.
Rejecting the terms of Maxwell’s plea agreement is a betrayal of trust.
Maxwell’s attorneys stated that failing to uphold the conditions of a plea deal reached in 2008 between Florida prosecutors and Jeffrey Epstein would damage the relationship of trust between the government and the public.
At the trial on Tuesday at a federal court building in New York, lawyer Diana Fabi Samson informed the court that the Department of Justice (DOJ) was investigating potential “corrupt” practices in the plea deal.
She stated that the sixth count was included in the plea deal and pertains to both the time and the specific individual under investigation in Florida.
“That charge should be precluded by the non prosecution agreement and should be dismissed. Denying the viability of this plea agreement strikes a dagger in the heart of the trust between the government and its citizens regarding plea agreements.”
